But the point is it's not a parody. It's a satire which is illegal. If they used "This Land" to poke fun at the original song then that would be a parody. They used it instead to poke fun at Bush/Kerry, which makes it a satire. Still I can imagine the Judge watching the flash animation, laughing, and dismissing the case.
